TruckSmarter, Inc., its subsidiaries, affiliates, successors and assigns (“TruckSmarter,” “we,” “our,” or “us”) values the privacy of individuals who use our website at www.trucksmarter.com, along with our related websites, applications, mobile applications, and other products or services provided by us (collectively, the “Services”). This privacy policy (the “Privacy Policy”) explains how we collect, use, and share information from users of the Services. This Privacy Policy also applies to a freight broker (“Broker”) who posts and manages loads, including relevant details regarding such loads, through the Service for truck drivers (“Drivers”) to view and book.
Information we collect
We may collect a variety of information from or about you or your devices from various sources, as described below. If you do not provide your information when requested, you may not be able to use the Services if that information is necessary to provide you with the Services or if we are legally required to collect it.
Information you provide to us
Registration and Profile Information. When you sign up for an account, register to use the Services, update your account, sign up for notifications or updates, subscribe to our newsletter or participate in our surveys, we may collect your name, commercial information, email address, password, phone number, mailing address, MC or DOT number, Broker representative information, and other information we identify.
Payment Information
When you add a payment method to your account, apply for factoring, or apply for a financial instrument through our banking partners, we collect your financial account information, such as payment card information, account numbers, or wire transfer information.
Load Board Login Information
If you choose to provide us with your login information for a third-party load board, we collect the login information you provide such as email address, password and one-time passcodes. Providing us with your login credentials gives us access to any of the information available to you in that third-party load board, including your account information, third-party information and loads available to you. TruckSmarter is not affiliated with or sponsored or endorsed by these third-party load boards.
Government Identifiers and Related Information
If you apply to use the Services, including applying for factoring or for a financial instrument such as a deposit account or debit card through our banking partner, we may need to collect certain government identifiers or employment information to help the government fight the funding of terrorism and money laundering activities. For example, we may collect your passport number, driver’s license number, social security number (SSN), Employer Identification Number (EIN), Tax ID or other government identifiers. We may ask to see identifying documents, such as a driver’s license, passport, or state identification card. In doing so, we may receive demographic data such as your age, race/ethnicity or national origin, and citizenship status. We may also ask for employment-related information such as your current job title and company name.
Contact List
When you opt-in to referring TruckSmarter to other users, we may collect your contacts to help facilitate that action.
Information Contained in Communications
If you communicate with us for customer support or other reasons, we collect your name, email address, phone number, the contents of a message or attachments that you may send to us, and other information you choose to provide. When we send you emails, we may use embedded pixels or other technologies to track information about your receipt and interaction with our emails, such as whether and when you open them, whether you access any links included in our emails, how long you read our emails, whether you forward our emails and to whom, your Location Information (described below), and your Device Information (described below), to learn how to deliver a better customer experience and improve our Services.
Email Integrations
If you connect your third-party email in connection with the Services, we may collect information from email messages and related attachments in the inboxes that you connect to your account.
User Content
Certain features of the Services may permit users to upload or otherwise transmit content to the Services, including load information, messages, text, documents, forum posts, photos, video, images, and any other works of authorship or other materials (“User Content”). If you choose to provide User Content, we collect such User Content.
Careers
If you apply for a job with us, we collect the information you choose to provide on your resume, such as your education and employment experience, as well as your contact information, references, and any other information you choose to provide in your application.
B. Information We Collect When You Use the Services
Location Information. When you enable location services while using the Services, we may receive your precise location information. You may stop the collection of precise location information any time (see the Your Choice section below for details). We may also infer your general location using your IP address regardless of whether you enable location services while using the Services.
Device Information
We collect information about the device and software you use to access the Services, including IP address, timezone setting, hardware model, web browser type, operating system version, phone carrier and manufacturer, application installations, device identifiers, mobile advertising identifiers, and push notification tokens.
Usage Information and App Activity
We automatically collect information about your interactions with the Services, like the pages or other content you view, the searches you conduct, the frequency of you searching, the bookings you make, the relevant load information, the purchases you make, your comments, any content you post, any responses generated from your use of the Services, and the dates and times of your visits.
Information from Cookies and Other Tracking Technologies
We and third-party partners collect information using cookies, pixel tags, SDKs, or other tracking technologies. Our third-party partners, such as analytics and advertising partners, may use these technologies to collect information about your online activities over time and across different services. Cookies are small text files containing a string of alphanumeric characters. We may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to the Services. Web beacons (also known as “pixel tags” or “clear GIFs”) are electronic images that we use on our Services and in our emails to help deliver cookies, count visits, and understand usage and campaign effectiveness. Call and Text Information
We work with service providers to facilitate customer support or other phone calls and/or text messages to you. We may also work with service providers to send fraud alert text messages to you. In such instances, we collect information regarding such communications, including the date and time of the call or SMS message, the phone numbers, and the content of any SMS messages or calls. For security, support, quality assurance and training purposes, we may also monitor and/or record phone calls made to us. By communicating with us, you agree to allow us to monitor and/or record your call.

Marketing Partners
We collect marketing data from our data enrichment and marketing partners and combine it with other information we have about you.
Our Banking Partner
We collect information about you from our banking partners and their third-party service providers about your deposit account activities. Any personal information we collect is pursuant to our partner bank’s privacy policy: Thread Bank Privacy Policy (as applicable) and their third-party service provider, Unit Finance Inc.’s (“Unit”) Privacy Policy.
Financial Account Linking
You may choose to link a financial account using third parties, such as Plaid Inc. (“Plaid”), to allow us to gather data about you from your financial institutions. By linking your financial account through these service providers, you grant us and these service providers, including Plaid, the right, power, and authority to act on your behalf to access and transmit your personal and financial information from the relevant financial institution. You agree to your personal and financial information being transferred, stored, and processed by these service providers, including Plaid, in accordance with their privacy policies. Credit Report, Background Checks and Business Information
We work with partners who may provide credit reports, perform background checks, and provide applicable business-related information, and collect personal information about you from such services.
Information from third-party services
If you choose to link our Services to a third-party account, we may receive information about you, including but not limited to your profile information, your use of the third-party account, any information that you have permitted the third party to share with us, and any information you have made public in connection with that service. If you wish to limit the information available to us, you should visit the privacy settings of your third-party accounts to learn about your options. Our use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use Requirements.
Information We Derive
We may derive information or draw inferences about you based on the information we collect. For example, we may make inferences about your approximate location based on your internet protocol (IP) address or infer that you might have other broker accounts based on broker accounts for which you have signed in through our Services.
How We Use the Information We Collect
We use the information we collect to provide, maintain, and improve the Services. We also use the information we collect to:
Enhance our Services, such as by using stored third-party load board login credentials to connect you to other broker accounts. We also use your login information for a third-party load board to (i) access third-party data on your behalf, (ii) electronically retrieve third party data on your behalf; (iii) bid and book loads through third parties on your behalf; (iv) validate carrier information; (v) validate load information; and (vi) use the information accessible to provide the Services;
Personalize your experience on the Services such as by providing tailored content and recommendations;
Monitor and analyze trends, usage, and activities in connection with our products and services and develop new products, services, features, and functionality;
Determine whether you qualify for the Services;
Facilitate transactions and payments;
Send you technical notices, security alerts, support messages and other transactional or relationship messages;
Communicate with you about our products, service, and events offered by TruckSmarter and others and, provide news and information that we think will be of interest to you (see the Your Choices section below for information about how to opt out of these communications at any time);
Facilitate the connection of third-party services or applications, such as freight load boards, fuel partners and their third-party service providers, or transaction partners such as our banking partners and their third-party service providers, including Unit;
Developing and providing promotional and advertising materials that may be relevant, valuable, or otherwise of interest to you;
Generate anonymized, aggregate data containing only de-identified, non-personal information that we may use to publish reports;
Verify your identity;
Assist our banking partners in determining whether to open a deposit account for you or verify the existence and condition of your deposit account;
Detect, investigate, and help prevent security incidents and other malicious, deceptive, fraudulent, or illegal activity and help protect the rights and property of TruckSmarter and others;
Comply with our legal and financial obligations, including enforcing our Terms of Service or other legal rights, or as may be required by applicable laws and regulations or requested by any judicial process or governmental agency; and
For other purposes for which we provide specific notice at the time the information is collected.
How We Disclose the Information We Collect
Affiliates
We may disclose personal information between and among TruckSmarter and our current and future parents, affiliates, subsidiaries, and other companies under common control or ownership.
Vendors and Service Providers
We may disclose personal information with vendors and service providers retained in connection with the provision of the Services, including truck stop operators and their third-party service providers and companies that assist us with payment processing, technical infrastructure, business analytics, fraud prevention, and marketing.
Brokers and Drivers
If you are a Broker, we may disclose any information you provide with a Driver in connection with the provision of the Services. If you are a Driver, we may disclose personal information with a Broker to track your viewing or selection of load information and otherwise provide the Services to you.
Transaction Partners
We may disclose personal information with transaction partners retained in connection with the provision of the Services, including our banking partners and their third-party service providers. We may disclose personal information in one or more of the following circumstances:
We may disclose personal information with individuals and entities who are involved with a specific transaction.
We may disclose personal information about you to third parties for servicing and processing transactions, to comply with the requests or instructions of our regulators, to protect against fraud, for risk control, or to perform services on either your or our behalf.
Unit may assist us in processing transactions, handing deposit account operations, and providing technological connection to our banking partners. In particular, Unit may perform any functions on your deposit account that we are otherwise authorized to perform. Unit’s access and use of your information is governed by Unit’s Privacy Policy, available at https://www.unit.co/clients-privacy-policy.
AI Service Providers
We may disclose information we receive to vendors that provide artificial intelligence services that provide backend support for our Services.
Analytics Partners
We use analytics services such as Google Analytics to collect and process certain analytics data. These services may also collect information about your use of other websites, apps, and online resources. You can learn more about Google’s practices by visiting https://www.google.com/policies/privacy/partners/. To help us understand how you use the Services and to help us improve them, we automatically receive information about your interactions with the Services, like the pages or other content you view, the searches you conduct, the bookings you make, the purchases you make, your comments, any content you post, and the dates and times of your visits.
Advertising Partners
We work with third-party advertising partners to collect and process your information in order to show you ads that we think may interest you. Some of our advertising partners are members of the Network Advertising Initiative (https://optout.networkadvertising.org) or the Digital Advertising Alliance (https://optout.aboutads.info) and serve ads through cookie-based technologies. Please visit their opt-out pages to learn about how you may opt out of receiving web-based personalized ads from member companies. These opt-outs will not apply to our third-party advertising partners that are not members of these organizations and will not apply when our partners serve ads through non-cookie-based technologies. You can access any settings offered by your mobile operating system to limit ad tracking, or you can install the AppChoices mobile app to learn more about how you may opt out of personalized ads in mobile apps.
As Required by Law and Similar Disclosures
We may access, preserve, and disclose your information if we believe that your actions are inconsistent with our user agreements or policies, if we believe that you have violated the law, or if we believe that doing so is required or appropriate to: (a) comply with national security or law enforcement requests and legal process, such as a court order or subpoena; (b) respond to your requests; or (c) protect your, our, or others’ rights, property, or safety.
Merger, Sale, or Other Asset Transfer
We may transfer your information in connection with the consideration, negotiation, or completion of a corporate transaction in which we are acquired by or merged with another company or we sell, liquidate, or transfer all or a portion of our assets.
Consent. We may also disclose your information with your permission or at your direction.

Location information
When you first launch any of our applications that collect precise location information, you will be asked to consent to the application’s collection of this information. If you initially consent to our collection of such location information, you can subsequently stop the collection of this information at any time by changing the preferences through your device’s operating system settings. You may also stop our collection of this location information by following the standard uninstall process to remove all of our mobile apps from your device.
Cookies
Most web browsers are set to accept cookies by default. If you prefer, you can usually adjust your browser settings to remove or reject browser cookies. Please note that removing or rejecting cookies could affect the ability and functionality of our Services.
Communication Preferences
You can unsubscribe from our promotional emails or text messages via the link provided in those communications. Even if you opt out of receiving promotional messages from us, you will continue to receive administrative messages from us.
If you have opted in to receive SMS messages from us for updates, alerts, or other information, you have the right to opt out at any time. To stop receiving text messages from TruckSmarter, reply STOP to any message you receive. Upon receiving your request, we will cease sending you SMS messages without delay. Please note that opting out of SMS communications does not preclude TruckSmarter from sending you service-related messages, such as transaction confirmations or important account notifications, as permitted by law. Do not track
We currently do not respond to Do Not Track signals.
Mobile Push Notifications
With your permission, we may send push notifications to your mobile device. You can deactivate these messages at any time by changing the notification settings on your mobile device.
International Users
TruckSmarter is headquartered in the United States and we have operations and vendors in the United States. We and those that perform work for us, may transfer your data from the U.S. to other countries or regions in connection with storage and processing of data, fulfilling your requests, and operating the Services. Such jurisdictions may not provide the levels of data protection that are equivalent to those of your home jurisdiction. Where required by law, we provide adequate protection for the transfer of personal data in accordance with applicable law.
Changes to this Privacy Policy
We may change this Privacy Policy from time to time. If we make changes, we will notify you by revising the date at the top of this policy. We will post any adjustments to the Privacy Policy on this page, and the revised version will be effective when it is posted. If we make material changes to this Privacy Policy, we will notify you through the Services, by email, or other communication.
